Know all men by these presents that we Thomas E Perley of __________________ in the __________________ as principal and ____________________ of _________________ in the __________________ as sureties are held and stand firmly bound unto Jeremiah Goodwin Treasurer of the State of Maine or his successors in that office in the sum of fifty thousand dollars to the use of said state to be paid to the Treasurer of said State of Maine or his assigns to the which payment well and truly to be made we bind ourselves our heirs executors and administrators jointly and severally firmly by these present. Witness our hands and seals dated the ____ day of _____ in the year of our Lord One thousand Eight hundred and thirty nine

The condition of this obligation is such that whereas I the said Perley on the thirteenth day of July AD 1839, on the Aroostook River in the said State of Maine at public auction there held by the Land Agent of said State, bit off by myself, and my agents, and agreed to purchase a large amount of timber of said State, at Three Dollars and one cent per ton. The Amount of which is not yet known by admeasurement, and whereas the condition of said purchase were that I[?] should[?] before the Timber should pass the Aroostook Boom secure the full amount of the purchase money by notes or bonds at the election of said Land Agent with good sureties to his satisfaction one responsible signer at least to be a citizen of said State of Maine, and further that one third part of the purchase money should be paid before said timber should pass the boom and the other two thirds in ninety days there after, and further that the Timber should be measured at the Boom or before it arived [arrived] there by some person to be appointed by the Land Agent or his deputy. And that the usual mode of admeasurement should be followed as to wane[?] edges – that the timber should be measured in the condition it might be in when so measured and that no allowance should be made for injuries to which it might be liable after it shall have passed said Boom – that should there be any disagreement about the admeasurement made as above stated the timber might be measured by Zebulon Ingersol of Houlton and Joel[?] Wellington of Manticook[?] Esqrs[?] in the same mode and on the same principles as before stated whose decision shall be final, and that the expense of which should be paid the one half by the State of Maine [last four words crossed out]
