Company in Litchfield; which elections took place after the fifteenth day of March last; and the persons so elected as officers, did vote at the election first mentioned; and those who were chosen Ensigns in the said two Companies had never received Commissions, consequently were not legal voters.

3. For that Captain Levi Eldred was absent from home and the orderly officer of said regiment not having knowledge of the fact, left a notice at said Eldred's house and the subalterns under him had no knowledge of the election first mentioned.

4. For that five commissioned officers belonging to said Regiment were absent from said first mentioned election exclusive of the subaltern in Capt Smith's Company and the subaltern in Captain Wyman's company and the three officers belonging to Capt. Eldred's Company before mentioned.
