Cyrus Fletcher had 2. Blanks 3. Whereupon Nathaniel S. Littlefield was declared duly elected to fill the vacancy in the Second Senatorial District.

Messrs. Manning and Benson of the Senate, and Messrs. Humphrey of Gray, Hamlin of Hiram and Allen of Bangor, of the House were appointed a Committee to receive, sort and count the votes for two Senators to fill the vacancies in the tenth Senatorial District.- Which committee, having attended to the duties assigned them, reported that the whole number of votes given in was 342. Necessary for a choice, 86. John H. Smith had 113. Marshall Whitney -"- 108. Daniel Steward, Jun -"- 61 Cyrus Fletcher -"- 57. Scattering 3. Whereupon John H. Smith and Marshall H. Whitney were declared duly elected, and the Convention separated.

On motion of Mr. Woodbury Ordered, that the Secretary of the Senate notify Nathaniel S. Littlefield that he has been constitutionally elected Senator to fill the vacancy in the Second Senatorial District; and John H. Smith and Marshall H. Whitney
