3 [1824 January 7] 4th Balloting Hon. Benj: Ames had 10 Votes " John Anderson 4 " " John McDonald 1 " " Samuel Whitney 1 "

[President chosen] the Hon. Benj. Ames was then declared elected, signified his acceptance and took the Chair.

The Senate then proceeded to the choice of a Secretary; the whole number of Votes given was sixteen[underscored], necessary to a choice nine[underscored], and Charles B. Smith had fourteen[underscored], and was declared elected. He then came in, signified his acceptance and took and subscribed the oaths required by the Constitution previous to entering upon the duties of the office, before Horatio Southgate, Esq. thereto authorized by Dedimus[underscored] Potestatem[underscored], in presence of the Senate.

[Message] On motion of Mr. McDonald ordered that a message be sent to the House informing them that the Senate was organized by the choice of the Hon. Benj. Ames for President, and Charles B. Smith for Secretary.

[Rules & orders] On motion of Mr. Small, ordered that the Rules and Orders in force for the government of the Senate that last year, be continued in force till others are formed and accepted.

[Message to the Governor] Mr. McDonald was charged with a message to the Governor and Council, informing them that the Senate was organized by the choice of the Hon. Benjamin Ames President; and Charles B. Smith Secretary, and were ready to proceed to business.
