63. The Committee appointed to consider and report the time, place & manner to be adopted in making choice of a Senator from this State in the Congress of the United States, reported, that to constitute an election of a Senator of this State in the Congress of the United States shall require the concurrent vote of both branches of the Legislature, and a majority of all the votes given in each branch respectively - that the House of Representatives shall on Thursday the 18th inst. at 11 oclock A.M. proceed to the choice of a Senator on their part by ballot & continue to ballot until a choice on their part be effected, or until they shall have balloted four times without effecting a choice, and thereupon the House shall cease to ballot & inform the Senate by Message of the election or failure to elect on their part, whereupon the Senate shall on the succeeding day at 11 oclock in the forenoon proceed to elect a Senator on their part by ballot - and if the Senate concur with the House in electing the same person on their part as was elected by the House, it shall constitute an election but if the Senate elect on their part a person other than the one elected on the part of the House, the Senate shall notify the House thereof by Message & the House shall thereupon assign some subsequent day for coming to an election on their part, & if upon such trial the House shall concur the Senate in electing on their part the same person as was elected on the part of the Senate, the person thus chosen shall be considered as duly elected a Senator of this State in the Congress of the United States, but if the House upon such trial shall non concur the Senate & on their part elect a person other than the one chosen by the Senate, the House shall notify the Senate thereof by message, & the like proceedings shall be continued by the respective branches until an election be effected, or further attempts be considered unavailing. In the event of the House of Representatives failing to come to an election on their part after their first four ballotings, & of the Senate not coming to a choice on their part after having taken four ballots, the Senate shall cease to ballot & notify the House thereof - whereupon the House shall assign a subsequent day for coming to a choice on their part & similar proceedings as before provided, shall be repeated by each branch until an election be effected - and the House accepted the report in concurrence with the Senate. -
