A message was received from the Senate by Mr Hutchinson their Secretary, informing the House, that they have amended the engrossed Bill entitled An Act in further addition to An Act to provide for the education of youth, and ordered the same to be reengrossed as thus amended and requesting the concurrence of the House – and the Bill was ordered to lie on the table.

The House took up the consideration of the Report of the committee on so much of the Governors Message as relates to a proportional distribution of the surplus funds of the United States to promote internal improvement & the accompanying Resolves – Mr Ames moved an amendment to the first Resolve which elicited much discussion, and before the question of adopting the same was taken, the House adjourned until 1/2 past two o clock this Afternoon.

To the Senate & House of Representatives

The Adjutant General having reported the resignation of Major General Jedidiah Herrick of the third Division, and the same having been accepted, I now make known to the two branches of the Legislature that the office of Major General of the third division of the Militia of this State is vacant - Enoch Lincoln

The foregoing, being read, on motion, the House assigned tomorrow at 1/2 past two o clock, to come to the choice on their part of a Major General for the 3d division.

Petition of Joel Wellington & al for a township of land on certain conditions was read & referred to the committee on State Lands in concurrence with the Senate.
