The Deposition of Philip Hubbard of lawful age, testifies and Says, that he the Deponant (Some time in the month of May, one thousand seven hundred and Seventy Seven, was at the house of Capt. John Underwood in Kittery, and that Said Underwood desired him to go after his Negro Boston and bring him home, and he the deponant went accordingly after Said Negro, and that Mr. John Trott went with him, and that they found Said Negro a catching Plaice in the crook opposite to Cutt's Island and that Said Negro came ashore to them on their calling him, and that Said Trott took hold of the Float that Said Negro came ashore in, and hauled her up to high-water mark, and the Negro asked us why we hauled up the float, and I told said Negro his master sent for him and he must go to him, and that Said Negro laid down his plaice Spear and went up to Capt. Underwood and Said Underwood immediately sent Said Negro on board a Privateer that lay in the harbour; and that he the Deponant and Said Trott were about three or four hours from the time they set out after said Negro till they brought him to said Underwood, and that said Negro made no resistance, and that he the deponant and Said Trott belonged to the aforesaid Privateer, and that Said Underwood was an officer on board Said Privateer, and that they Sailed in two or three days after they brought said Negro to Said Underwood, and further saith not

York ss. April 23d. 1785 Then the above named Philip Hubbard personally appearing, and after being duly examined and cautioned to testify the whole truth, made solemn oath to the truth of the above Deposition by him subscribed, the same being taken to be used in an action or plea of the case, to be heard and tried at the Court of Common Pleas, to be holden at York, within and for the county of York, on the fourth Tuesday of April instant, by adjournment from the second Tuesday of April instant, when and where John Trott of Kittery in said county is Plaintiff and John Underwood of Kittery aforesaid is Defendant. The cause of caption is that the Deponent being bound to Sea, taken at the request of said Underwood, the adverse party being notified and present.
