I Samuel Curry of lawful age on oath do testify & say that in the month of May [?]1857 I went from Calais to Perry with Seth W. Smith. That while we were there Mr. Smith called on Mr. John McCarty to see if he could purchase seed oats for the Indians. Mr. McCarty said that he had no oats for sald, & that he did not know of any for sale in Perry. Mr. Smith then called on mr Charles S.[?] Davis of Perry. Mr. D. said he did not think there were any oats for sale in Perry, & that oats could not be purchased in Perry at that time. He then inquired for oats of several of the Indians, & they told him he could not buy them in Perry and that he must send them down from Calais. Mr Davis is a merchant and trades in oats & potatoes & other kinds of produce.

I have been in company with Mr. Smith more than any other man when he has been doing his business with the Indians. I have been to Perry with him every spring since he has been Indian Agent, and twice I think in the fall, and have been with him up to Peter Danas Point two or three times, when he has been doing his business with the Indians.
