On motion by Mr. Barnard of Alna Ordered that the Committee on the Judiciary be directed to inquire into the expediency of so far amending the law relative to cost - in criminal prosecutions that no fees shall be allowed to witnesses on the part of the State in criminal prosecutions until the third day of the term of the Supreme Judicial Court - and that such witnesses at the preceding term shall be recognized to make their appearance at the next term on said third day - sent up for concurrence

Agreeably to assignment the two Branches met in Convention for the purpose of coming to the choice of a Treasurer of State - The whole number of votes given in was One Hundred & sixty three - necessary for a choice - Eightytwo - Abner B. Thompson had ninety votes & was declared to be duly elected

On motion of Mr. Boutelle of Waterville Ordered that the Committee on the Judiciary be instructed to inquire into the expediency of so altering the law that after a civil action has been committed to a jury & the jury have not been able to agree on a verdict - that at the next trial of said action a verdict of a less number than twelve shall be received & allowed & judgment therein rendered sent up for concurrence

The House resumed the consideration of the report of the Committee raised to examine & consider the best mode of raising a valuation Committee - and the question of amending the report agreeably to the motion of Mr. Dummer of Hallowell so that all the members of the valuation Committee should be taken from the Legislature & none from the people at large was taken by yeas & nays as
