7 A Committee consisting of Messrs. Clifford of Newfield Kent of Bangor, Cilley of Thomaston, Phelps of Fairfield and Swett of Prospect was appointed to receive sort and count the votes for a Clerk, and on counting the same it appeared that the whole number given in was one hundred and sixty eight - necessary to a choice eighty five – Joseph G. Cole had one hundred and seventeen – Richard H. Vose had forty one – scattering ten – and Joseph G. Cole was declared elected, and being present, took and subscribed the oath of Office which was administered to him by Reuel Williams Esq a magistrate for the County of Kennebec, as follows, I Joseph G. Cole do solemnly swear that I will faithfully discharge to the best of my abilities the duties incumbent on me as a Clerk of the House of Representatives of the State of Maine – So help me God.

The Clerk having been duly qualified, presided during the further organization of the House.

A Committee consisting of Messrs Knowlton of Montville, Dummer of Hallowell, Bailey of Parsonsfield, Hamlin of Columbia and Smith of Gray was appointed to receive sort and count the votes for a Speaker – and on counting the same it appeared that the whole number given in was one hundred and seventy three necessary to a choice, eighty seven – Benjamin White had one hundred and eighteen – Edward Kent has forty seven - William Clarke five – Jeremiah O'Brien one – Ebenezer L. Phelps one – Nathan Clifford one – and Benjamin White of Monmouth was declared elected.

Mr. Williams of Augusta was charged with a Message to the Senate informing them of the organization of the House by the election of Benjamin White Speaker and Joseph G. Cole Clerk.
