I William W. Pike of lawful age on oath do testify & say, that I was present, in the spring of 1857, at an auction, when Seth W. Smith purchased a quantity of potatoes. They were sold under the direction of Hugh Slater. I examined the potatoes & know that they were good & sound. after Mr. Smith purchased his quantity, & on the same day of the sale, I offered him ten dollars for his bargain, & he declined taking it.
