Because the said James M. Roberts is guilty of the crime of having had in his custody and profession a certain forged false and counterfeit Bank Bill on promissory note, purporting to have been issued for and in behalf of the President, Directors and Company of the Kennebec Bank; and of having uttered and tendered the same in payment as true to one Syms Gardiner, knowing the same to be false, forged and counterfeit, with intent to defraud the said Gardiner, contrary to a law of this State.
