WHEREAS it hath been made to appear to me, by the Inquisition of the Selectmen of the town of Frankfort [handwritten] taken and returned to me as the law directs, that Hatevil Colson [handwritten] of said town of Frankfort [handwritten] is a no compos mental or insane person is also of my own knowledge of the part [handwritten]
Therefore, Know Ye [italicized] That I the said Judge, trusting in the care and fidelity of Philo H. Washburn of said Frankfort Esquire [handwritten] have, and by these Presents do pursuant to the power and authority to me granted in and by an act or law of the said Commonwealth [stricken] State [handwritten insertion] entitled, "An Act empowering the Judges of Probate to appoint Guardians to Minors and others,") assign and appoint the said Philo H. Washburn [handwritten] to be guardian of the said Hatevil Colson [handwritten] hereby directing and empowering him[handwritten] in said capacity, to take care, as well of the person as estate, both real and personal, of the said Hatevil Colson [handwritten] and to make a just and true inventory of the said estate, to be exhibited into the Register's Office of Probate for the county aforesaid: and the said guardian shall improve, frugally, and without waste and destruction, the estate afore-mentioned, and apply the annual profits and incomes thereof for the comfortable maintenance and support of the said Hatevil Colson [handwritten] and also of his [handwritten] household or family (if any such he[handwritten] have) And the said guardian is hereby empowered to settle accounts, receive and (if need be) sure for and recover all such debts as are due to the said Hatevil Colson [handwritten] from any person or persons whomsoever; and to manage, improve, divide, and take care of his [handwritten] real estate, in as full and ample a manner as he [handwritten] would or might do, were he of sound mind and direction [handwritten] And the said guardian shall also pay all such debts as are owing from the said Hatevil Colson [handwritten] out of his [handwritten] personal estate; or in case that be not sufficient, then out of his [handwritten] real estate, (being first empowered to make sale thereof, or of such part thereof as shall be sufficient for that end, by the Supreme Judicial Court, upon application to them made therefore) and he [handwritten] shall render a plain and true account of his [handwritten] guardianship, when and so often as he [handwritten] shall be thereunto lawfully required. And in case the said Hatevil Colson [handwritten] should be restored to the use of his [handwritten] reason, he [handwritten] shall return and deliver the residue and remainder of his [handwritten] estate, real and personal, until him [handwritten] or, in case of his [handwritten] death, to his [handwritten] heirs, executors, or administrators.
