Remonstrance of Elias Foss and als, of Limington against the election of Simeon Strout Junr returned as a member from said town, was read and referred to the Committee on Elections.
Agreeably to assignment the two branches of the Legislature assembled in the Representatives chamber at 10 o clock and proceeded by ballot to the election of a Senator to fill the vacancy occasioned by the resignation of Mark Sheppard. The whole number of votes given in was one hundred and fifty three – necessary to a choice seventy seven – Samuel Whitney had seventy five, Samuel M Pond seventy four. Samuel S Pond two. Samuel L. one & there was one double vote for Samuel M Pond, whereupon the Chairman declared that there was no election, and the committee were proceeding to receive votes on a second ballot when Mr Boutelle rose and moved the convention that Samuel M Pond be declared elected on the first ballot, and the motion prevailed 85 pro. 57 con. & then the Chairman declared Samuel M Pond duly elected. The Convention then proceeded to the choice of seven Counsellors – The whole number of votes given in was One hundred & fifty six necessary to a choice Seventy nine – Daniel Wood had seventy nine, William Chadwick had ninety nine, Jonathan Thayer had one hundred & fifty two, Joseph Shaw had one hundred & two, John Balkam had one hundred & fifty five, Joel Wellington had one hundred & three and Joel Whitney Seventy nine & they were declared elected.
The convention then proceeded to ballot for a Secretary of State – The whole number given in was One hundred & forty six. Necessary to a choice Seventy four. Amos Nichols Esqr had One hundred & fourty four& was elected.
The Senate then withdrew and the House
