(54) Friday 5th February 1830. The Senate met according to adjournment. [appeal under consideration] The Senate resumed the consideration of the question on the appeal made yesterday by Mr. Kingsbury, from the decision of the President. [motion on appeal] Mr. Kingsbury moved that the question on his appeal aforesaid be put in the following words "Shall the opinion of the chair stand as the judgement of the Senate". [motion decided out of order] The motion of Mr. Kingsbury was decided to be out of order, by the President, who then declared that the question taken in the forenoon session of yesterday, by yeas and nays, was decided in the negative.

[Com to investigate the subject of threats &c] On motion by Mr. Kingsbury, Ordered, tat Messrs. Kingsbury, Megquier & Phelps be a Committee to investigate the subject alluded to in debate yesterday, in relation to threats and anonymous letters received by a Member of this Board, with power to send for persons.

[Pet. of Joseph Whitney & als] Order of the House of Representatives, requesting the Senate to take from their files of the last year, and send down the Petition of Joseph Whitney and others, was read and request granted.

[Committee on School Dist. raising money,] Orders of the House of Representatives that the Committee on the Judiciary be instructed to inquire into the expediency of authorizing School Districts to raise money for the support of Schools, in addition to the amount raised and assessed by the Towns in which they are situated.

[Committee on mortgaged Real Estate] Also, that the same committee be instructed to inquire into the expediency of providing by Law, in cases of mortgaged Real Estate, for securing to Creditors by attachment or otherwise, a lien on the Mortgagees' interest.
