[55] Friday January 11, 1822

[Committee on Law of tender] Ordered that Messrs. Poor and Bond, with such as the House may join, be a committee to take into consideration the expediency of passing a law by which Defendants in all civil actions may have the privilege of a tender to the Plf. or his Attorney the amount of debt and legal costs already risen, at any time previous to the entry of the action, and thereby stop any further proceedings and costs, with leave to report by bill or otherwise.

Sent down for concurrence. Came up concurred and Messrs. Gray, Fox and Sheppard were added by the House.

[Message for Convention to qualify Councellors] Ordered that a message go to the House of Representatives proposing a convention of both branches of the Legislature in the Representatives Chamber this day at eleven o'clock for the purpose of qualifying such counsellors elect as have signified their acceptance and are ready for that purpose, and also to choose a Treasurer.

"Mr. President, The House of Representatives concur with the proposition of the Senate for a convention of both Houses this day to qualify such counsellors elect, as have appeared for that purpose, and also to choose a Treasurer of the State.

On motion by Mr. Morrill ordered that the petition of Peter Cummings be taken from the files of the Senate and placed in the hands of the Committee on incorporation of Towns.

[Choice of Messenger] At the time assigned for the choice of Messenger, the ballots were taken, and the whole number were sixteen, of which John Merrill had thirteen votes, and was declared chosen.

[Bill] Bill to incorporate the Master, Wardens and Members of the United Lodge, read a second time and passed to be engrossed. Sent down for concurrence.
