Mr Fessenden of Portland submitted the following Order –

Ordered that the Justices of the Supreme Judicial Court be requested to give an opinion to this House on the following questions – viz.

1st has a town, having a right to choose a Representative, the power to wave that right, and vote not to choose a Representative and would such vote bind the minority in such town.

2d Have towns and plantations classed in Districts for the purpose of choosing a Representative, a right to send a Representative when a majority of the towns or plantations have voted to not send – and further ordered that the Clerk of this House transmit the foregoing order to said Justices of the Supreme Judicial Court forthwith, and request an early decision of the questions proposed.

An order came from the Senate for concurrence referring the letter from the Treasurer of the State with the annual report thereto annexed, to Messrs Parsons & Churchill with such as the House may join – and the House concurred and Messrs Clark of Hallowell, Eveleth of Windham and Hazeltine of Searsmont were joined.

Petition of William F Gilmore and als, referred in this House yesterday to the Committee on Bridges, Turnpikes & Canals came from the Senate nonconcurred and referred to the committee on Interior fisheries – and the House concurred.

Ordered that Messrs Samson of Waldoboro, Warren of Palmyra and Cummings of Buckfield with such as the Senate may join be a committee to enquire into the expedience of passing an act to prohibit the setting of fires for the purpose of clearing lands or other purposes within certain seasons of the year – read & passed. Sent up for concurrence.

Ordered that the committee on the Judiciary be directed to enquire if any alteration in the Laws of the State are
