State of Maine.

To James M. Rogers, of Bowdoin, Esquire,

Greeting:

Whereas, on the fifth day of August, in the year of our Lord one thousand eight hundred and sixteen, you were duly elected to be Colonel of the third Regiment, in the first Brigade and then eleventh Division of the Militia of the Commonwealth of Massachusetts, but now the third Regiment, in the First Brigade and fourth Division of the Militia of this State; and to that office duly commissioned by the Governor and Commander in Chief of that Commonwealth, under the seal of said Commonwealth, to take rank from said fifth day of August: And whereas the address of both branches of the Legislature of this State has been presented to our Governor and Council, requesting your removal from every civil and military office, which you now hold under this State: by which Address it appears, that you are guilty of the crime of having had in your possession a certain false, forged and counterfeit bank bill or promissory note, purporting to have been issued for and in behalf of the President, Directors and Company of the Kennebec Bank, and of having uttered and tendered the same in payment as true; to one Syms Gardner, knowing the same to be false, forged and counterfeit, with intent to defraud the said Gardner; and further that the Legislature believe from credible information, that you have been extensively concerned in the importation and circulation of counterfeit bank bills within this State, to the great detriment of the Citizens:

Whereupon our Council have advised that you be removed from said office:

WE therefore command you, that you henceforth surcease the execution of the duties of said office.

Witness Albion K. Parris, our Governor and Commander in Chief, and our seal hereunto affixed, at Portland, this thirteenth day of February, in the year of our Lord one thousand eight hundred and twenty three; and in the forty seventh year of the Independence of the United States of America.
