Agreeably to assignment the two Houses met in Convention in the Representatives Chamber for the purpose of choosing a Counsellor in the place of Joseph Shaw Esquire who declined accepting that office, to which he had been elected, The Committee appointed to receive sort and count the votes reported that the whole number of votes given by the Convention was 128 necessary to constitute an election 65 and that Samuel Whitney had 125 Aaron Holbrook 2 and Daniel Merrill 1 whereupon Samuel Whitney was declared constitutionally elected. the Convention then separated

In Senate

On motion Mr Stebbins, ordered, that the Secretary of State notify Samuel Whitney that he has been duly elected, by both branches of the Legislature in Convention, a Counsellor to advise the Governor in the Executive Department for the current year and request his attendance. Sent down for concurrence. Came up concurred.

On motion by Mr Williams, Ordered, that the messenger of the Senate be directed to procure an enlargement of accommodation at the Senate Board , by providing a movable table to be placed between seats No.19 and 20, to be occupied by the members who show
