Agreeably to assignment the Senate, on their part, proceeded to ballot for the choice of a Major General of the fourth Division. The Committee appointed to receive, sort and count the votes reported that the whole number of votes given was - 18 Necessary to constitute an election 10 and that Richard F. Dunlap had 9 and Samuel Winter - 9 Second Ballot Whole number of votes 18 Samuel Winter had - 11 and Richard F. Dunlap 7

Whereupon Samuel Winter was declared elected, on the part of the Senate and a message was sent to the House informing them thereof and requesting their concurrence.

Report of the Committee on the subject of Lotteries granting leave to withdraw on the petition of Thomas Merrill and others, came back from the House, they having refused acceptance thereto, and ordered leave for a Bill, and now the Senate adhere to their former vote whereby they accepted the report Sent down.

The Secretary of State came in and laid on the table a special message from the Governor transmitting a memorial of John Neptune and Peale Mauly, in behalf of the Penobscot tribe of Indians, which were read and referred to the Committee on State Lands, Sent down for concurrence. Came up concurred.
