(31) Wednesday 27th January 1830 The Senate met according to adjournment. Mr. Phelps called for the order of the day, and the call was sustained.

[Another motion relative to Mr. Pike] Mr. Megquier withdrew his motion last submitted in the afternoon session of yesterday, and moved that so much of the report of the Committee on the returns of votes for Senators as allows Benjamin Pike a seat at this Board be rejected, and this question, on motion by Mr. Steele, being ordered to be taken by yeas and nays was decided as follows; [Yeas] Yeas Messrs. Drummond, Gardner, Healey, Hilton, Hinds, Kingsbury, Morse, & Phelps - 8 [Nays] Nays Messrs. Davee, Dunlap, Hall, Hutchinson, Hutchings, Ingalls, Megquier & Steele -8

[vote reconsidered] This last vote was reconsidered, because, as it was alleged, the question was put in words not used by the Mover.

[Motion relative to order] Mr. Megquier then renewed his motion. An appeal was made to the Chair "whether the motion of Mr. Megquier was in order". The Chair decided that the motion of Mr. Megquier was in order. An appeal was then made to the Senate from the decision of the Chair, and the question "Should the Chair be sustained in his decision" which was ordered to be taken by yeas and nays, was decided as follows; [Yeas] Yeas Messrs. Davee, Dunlap, Hall, Hutchinson, Hutchings, Ingalls, Megquier and Steele - 8
