question was taken by yeas & nays & decided in the affirmative as follows Yeas 73 nays 59 [see appendix page 311] and then the Bill was passed to be engrossed in concurrence with the Senate.

An order came from the Senate for concurrence directing the Committee on the Judiciary to inquire as to the expediency of abolishing the punishment of death in certain cases - and the House concurred.

Bill to incorporate the Portland Rifle Cadets, was read 1st & 2d time & tomorrow at ten o clock assigned for a 3d reading

The committee on engrossed Bills reported as duly engrossed, An additional Resolve for opening & clearing a road from the South line of township number two Old Indian Purchase on the East side of Penobscot river to Mattanawcook Stream Resolve - in favor of Zadock Bishop & eighteen others - - for the relief of Charles Hogan, Benjamin Jones & John Foster - which were severally finally passed. Sent up for concurrence.

Bill to incorporate the Proprietors of Anson Bridge, was read a third time & passed to be engrossed. Sent up for concurrence

On motion of Mr Boutelle of Waterville Ordered That the Committee on the Judiciary be instructed to inquire into the expediency of making provision by law for having accurate returns of the births, deaths & marriages in the several towns made annually to the Secretary of State. read & passed. Sent up for concurrence.

An additional Resolve in favor of Joel Wellington & Samuel Whitney, was read 1st & 2nd time and passed to be engrossed in concurrence with the Senate.
