Petition of William Lord & others of Kennebunk praying for authority to straighten the Mousom River, was read & referred to the Committee on Turnpikes, Bridges & Canals. Sent up for concurrence.
Agreeably to the order of the Convention passed this morning the Convention reassembled in the Representatives Chamber at three oclock PM - when the Chairman, decided the motion made by Mr Smith of Nobleboro, to be out of order - Mr Megguire moved an appeal from the decision of the Chairman upon that question and the question "Shall the decision of the Chair stand as the Judgement of the Convention" was then put to the Convention and decided in the affirmative as follows Yeas 87 Nays 76 (See appendix page 319) Mr Dunlap of the Senate then read a Protest signed by himself and others, (for which see appendix page [blank]) which on motion was Ordered to be entered upon the Journal of the Convention - The Committee appointed for the purpose this morning, then proceeded to receive sort and count the votes for seven Councillors to advise the Governor in the Executive department of the Government - and having attended to the duties assigned them, reported the whole number of votes given, to be One hundred & sixty - necessary to constitute an election eighty one - Elisha Allen had eighty three, David Crowell had eighty one - Lemuel Paine had eighty five -
