A message was received from the Senate by Edward Kavanagh their Secretary, communicating the following Order, which was read to the House by the Speaker, viz "Ordered That a message be sent to the House of Representatives, that the Senate nonconcur the House in their proposition to meet in Convention, this day at 11 oclock A.M. for the propose of filling deficiencies in the Senate, for the following reasons: First, Because the Senate have not determined what deficiencies exist in the Senate. Second, Because the Senate have not ascertained who are the Constitutional Candidates to fill such deficiencies, if any exist. But the Senate will communicate with the House of Representatives as soon as deficiencies in the Senate are determined, and the Constitutional Candidates ascertained, proposing a convention of the members of the two Houses for the purpose of filling such deficiencies"

The following Senators came in and had seats assigned to them by the Speaker viz James Drummond, Syms Gardner, Halsey Healey, Ebenzer Hilton, Asher Hinds, Ebenezer S Phillips, Elijah Morse, S. Kingsbury - and thereupon,

Mr Ruggles of Thomaston presented a Protest signed by himself and a large number of the members of the House, which was read and on motion Ordered to be entered upon the Journal of the House, for which see appendix page 229)

The Speaker then stated to the House, that a convention of the members of the House and the above named Senators being now formed, the appropriate business of the House would be suspended until after the business of the convention should be accomplished.

The business of the Convention having been accomplished and the Senators aforesaid withdrawn, the House, Adjourned until half past nine oclock tomorrow morning.
